1. Acceptance of Terms

By accessing and using MasteryMind, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service.

2. Description of Service

MasteryMind is an educational platform for students in Years 3 to 13 following the UK curriculum — primary and Key Stage 3 practice through to GCSE and A-Level examinations. Our service includes adaptive quizzes, exam practice, revision tools, and AI-powered study assistance.

3. User Accounts

To use MasteryMind, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

4. Age Requirements and Parental Consent

MasteryMind is used by students from Year 3 to Year 13, so some of our students are under 13. Which route applies depends on your age:

• 13 and over: you can create an account and agree to these terms yourself. UK data protection law sets 13 as the age at which you can consent to an online service on your own behalf.
• Under 13: a parent or guardian must set the account up and agree to these terms on your behalf, and remains responsible for it. If you are under 13 and created an account yourself, please ask a parent or guardian to confirm they are happy for you to use MasteryMind — or contact us and we will close it.
• Under 18: by using MasteryMind you confirm that a parent or guardian knows you use it and agrees to these terms.
• School accounts: where your school provides MasteryMind, the school agrees to these terms for its students and is responsible for the consent and notification its own policies require.

If you believe a child has an account without the consent described above, email support@masterymind.com and we will delete it.

5. Acceptable Use

You agree not to:

• Share your account with others
• Attempt to access other users' accounts or data
• Use the service for any unlawful purpose
• Interfere with or disrupt the service
• Copy, modify, or distribute our content without permission
• Use automated systems to access the service

6. AI-Generated Content Disclaimer

MasteryMind uses artificial intelligence to generate educational content, including questions, explanations, feedback, and study materials. By using our service, you acknowledge and accept that:

• AI may produce errors: AI systems can "hallucinate" or generate inaccurate, incomplete, or misleading information. Content may contain factual errors, outdated information, or responses that appear correct but are wrong.
• Not a replacement for teachers: AI-generated content is supplementary and should never replace qualified teachers, official textbooks, or exam board materials.
• Verify important information: You should always cross-reference AI-generated content with official curriculum materials, mark schemes, and teacher guidance before relying on it.
• No guarantee of accuracy: We do not warrant that AI-generated content is accurate, complete, current, or suitable for any particular purpose.
• Exam preparation at your own risk: While we design content to align with UK curricula, we cannot guarantee that AI-generated questions or explanations reflect actual exam content or marking criteria.

You use AI-generated content entirely at your own risk. MasteryMind accepts no liability for any loss, damage, or adverse consequences arising from reliance on AI-generated content.

7. Educational Content

MasteryMind content is provided for educational purposes only. We do not guarantee exam results, grades, or academic outcomes. Content should be used alongside official curriculum materials, exam board specifications, and teacher guidance. You are solely responsible for your academic performance.

8. NEA Coach Disclaimer

Our NEA Coach feature is designed to support coursework development while respecting JCQ guidelines. However, you are solely responsible for ensuring your final submission meets all exam board requirements. MasteryMind does not guarantee compliance and is not liable for any coursework penalties.

9. Intellectual Property

All content, features, and functionality of MasteryMind are owned by us and protected by copyright, trademark, and other intellectual property laws. Your use of the service does not grant you ownership of any content or materials.

10. Subscription and Payments

Some features require a paid subscription. Payment terms, refund policies, and subscription details are provided at the point of purchase. Subscriptions automatically renew unless cancelled.

11. Limitation of Liability

To the fullest extent permitted by law:

• MasteryMind is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the service will be uninterrupted, error-free, or free from harmful components.
• We expressly disclaim all warranties regarding AI-generated content, including warranties of accuracy, completeness, or fitness for purpose.
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to poor exam results, academic penalties, or reliance on inaccurate content.
• Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

You acknowledge that educational outcomes depend on many factors beyond our control, including your effort, study habits, and teaching quality.

12. Indemnification

You agree to indemnify and hold harmless MasteryMind, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your violation of these terms, or your reliance on AI-generated content.

13. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

14. Termination

We may suspend or terminate your account if you violate these terms. You may also delete your account yourself, at any time: Profile → Account & Security → Danger zone → Delete account in the web app, or You → Delete account in the mobile app. Cancel any paid subscription first — we check before deleting and will stop and tell you if one is still live, so you are never left paying for an account that no longer exists. 15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
